1. Introduction

Beenokle ("we", "our", or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our websites, applications, products, or services (collectively, the "Services").

Please read this Privacy Policy carefully. By using our Services, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with our policies and practices, do not use our Services.

Beenokle (sole proprietor Ruslan Agarizaev operating under the trade name "Beenokle") acts as the data controller (operator under Russian law) for personal data processed through the Services.

Note: This English version is provided for convenience only. In the event of any inconsistency or conflict, the Russian version shall prevail.

2. Information We Collect

We collect several types of information from and about users of our Services, including:

2.1 Personal Data

Personal Data refers to information that identifies you or could reasonably be used to identify you. We may collect the following Personal Data:

  • Identity Information: Such as your name, username, or similar identifiers.
  • Contact Information: Such as your email address, postal address, and telephone number.
  • Date of birth and country of usual residence: to check account-creation eligibility.
  • Financial Information: Such as payment card details when you purchase our Services.
  • Profile Information: Such as your preferences, feedback, and survey responses.
  • Usage Information: Such as information about how you use our Services.

2.2 Technical Data

When you use the website and the applications, we receive technical data: your IP address, the kind of device, its operating system, the browser or application and its version, and the interface language. We use it to run the Services, for security and for the product usage record (section 3.1). The IP address is not stored in the usage record: we read your country and city from it.

On beenokle.ru, with your consent, we collect data about visits: which pages were opened, when, and where you came from.

3. How We Collect Your Information

We collect your information through various methods, including:

  • Direct Interactions: When you create an account, subscribe to our Services, participate in surveys, or correspond with us.
  • Automated Technologies: When you use our Services, we may automatically collect Technical Data about your equipment, browsing actions, and patterns. This data is collected by using cookies, server logs, and other similar technologies. We always count how often the pages of our sites and web apps are opened, where visitors come from and how many installers are downloaded, but without cookies and without anything that could recognise a person: the page address, the site you came from, link tags, country, city and device type. We do not keep the IP address or the browser string for this, and the visitor key lasts one day and means nothing afterwards. Any other website analytics runs only with your consent. All of it runs in our own system (Beenokle Accounts).
  • Application usage records: how you use Beenokle Dos, Beenokle Model and ZenWriter — see section 3.1.
  • Third Parties: We may receive information about you from third parties such as payment processors.

3.1 Product Usage Records

To run our services and improve them, we keep a service record of how you use our applications: when you sign in and open an application; from which device (phone, tablet or computer, its system, the browser or app and its version); which features from our list you use and how much you create — for example, how many tasks you created and completed; when the application updates; sign-ins and changes to your subscription.

The record is linked to your account and to the device you signed in on. We read your country and city from your IP address and do not store the address in this record. We never collect content: the text of tasks, notes, comments or documents, the names of projects, lists or files, file paths, page addresses with their parameters, or anything you type.

The record is kept in our own system, Beenokle Accounts, in your account's region, is not shared with third parties and is not used for advertising. It is kept for as long as your account exists and is deleted with it. We do not use advertising or third-party analytics.

The record is part of the service and has no switch of its own. We rely on our contract with you for sign-in and subscription records and on our legitimate interest in developing our products for feature usage. You have the right to object to the feature-usage record at any time: write to us (section 15) and we will stop it for your account. Sign-in and subscription records continue: the service does not work without them.

Without an account. Beenokle Model works without an account, and Beenokle Dos can be used without signing in. Then launches and features are reported without an account: from the installed Model under a random installation number, otherwise under the number of a single visit that is not stored on the device. They are not linked to you, are never joined to an account — including when you sign in — and are kept for 12 months. Earlier versions of the applications, until they update, send anonymous statistics that can be switched off in their settings.

Beenokle Dos failure reports — the kind of error, its message and the place in the program, and your account if you are signed in — go to the Dos server so the error can be fixed. We delete them three months after the error last occurred.

4. How We Use Your Information

We use your information for various purposes, including:

  • To provide and maintain our Services
  • To notify you about changes to our Services
  • To allow you to participate in interactive features of our Services
  • To provide customer support
  • To gather analysis or valuable information so that we can improve our Services
  • To monitor the usage of our Services
  • To detect, prevent, and address technical issues
  • To fulfill any other purpose for which you provide it
  • Your account, sign-in, subscription, payments and the service itself — performance of our contract with you (GDPR art. 6(1)(b); item 5, part 1, art. 6 of Russian Federal Law 152-FZ).
  • Which features are used (section 3.1) — our legitimate interest in developing our products (GDPR art. 6(1)(f); item 7). We record only what is listed, without content, so as not to override your rights.
  • Counting site visits and downloads without cookies — our legitimate interest in knowing how many people come to our sites and from where (GDPR art. 6(1)(f); item 7). It cannot identify anyone.
  • Other website analytics on beenokle.ru — your consent in the cookie settings.
  • Records we must keep by law, such as accounting records — compliance with the law.

5. Disclosure of Your Information

We may disclose your information to the following categories of recipients:

  • Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as hosting providers and payment processors.
  • Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy.
  • Business Transfers: If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
  • Protection of Rights: We may disclose your information to protect and defend the rights, property, or safety of Beenokle, our customers, or others.

6. Data Security

We implement appropriate technical and organizational measures to protect your Personal Data against unauthorized or unlawful processing, accidental loss, destruction, or damage. However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

7. Data Localization

Personal data of users in the Russian Federation is processed and stored on servers located within the RF. We use REG.RU and Yandex Cloud infrastructure for hosting and processing data within the Russian Federation in accordance with Federal Law 242-FZ.

For international users (outside the Russian Federation), data may be processed and stored in the United States using Google Cloud infrastructure.

8. Data Retention

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

Retention periods:

  • your account and its product usage record — while the account exists; they are deleted with it;
  • usage without an account (Beenokle Model, Beenokle Dos signed out) and website analytics — 12 months;
  • cookieless counts of site visits and downloads — 25 months;
  • failure reports — three months after the error last occurred;
  • IP addresses in security logs — 30 days, an anonymised network marker — up to 180 days;
  • payment and accounting records — as long as the law requires.

9. Your Data Protection Rights

Depending on your location, you may have certain rights regarding your Personal Data. These rights may include:

  • The right to access your Personal Data
  • The right to rectify or update your Personal Data
  • The right to erase your Personal Data
  • The right to restrict the processing of your Personal Data
  • The right to object to the processing of your Personal Data (GDPR art. 21) — including the feature-usage record we keep on the basis of legitimate interest (section 3.1)
  • The right to data portability
  • The right to withdraw consent

10. Children's Privacy

Our Services are not intended for children under 13. Creating an account also requires the minimum age applicable to the country stated at registration, which may be higher than 13. We do not knowingly collect data from children below that age. If you are a parent or guardian who believes such an account was created, please contact us so we can review it and take appropriate action.

11. International Data Transfers

For users in the Russian Federation, the processing and storage of Personal Data is carried out within the territory of the Russian Federation. For international users, data may be stored in the United States via Google Cloud.

Cross‑border transfers may occur only where necessary to fulfill our obligations and subject to adequate data protection safeguards, in accordance with applicable Russian data protection laws (152-FZ, 242-FZ).

12. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
